Terms and Conditions of Use

1. Scope and Acceptance
These Terms and Conditions govern your use of PlanningMe CH ("the Service"), a workforce planning platform operated by ithubdigital ("Provider"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
The Service is made available to you by your employer ("Company"), which has entered into a separate agreement with the Provider. Your use of the Service is subject to both these Terms and your Company's internal policies.
2. Description of the Service
PlanningMe CH is a web-based application that allows companies to manage workforce scheduling, shift assignments, absence requests, and related planning activities. Features accessible to you depend on the role assigned by your Company administrator.
3. User Obligations
You agree to:
- Use the Service only for its intended purpose and in accordance with applicable law.
- Keep your login credentials confidential and not share them with any third party.
- Notify your Company administrator immediately if you suspect unauthorised access to your account.
- Not attempt to access data belonging to other employees beyond what is necessary for your role.
- Not use the Service to transmit harmful, unlawful, or inappropriate content.
4. Accounts and Access
Your account is created and managed by your Company administrator. The Provider does not independently verify your identity. Access is granted through a one-time code sent to your registered email address. You are responsible for ensuring that your registered email address is current and secure.
The Provider reserves the right to suspend or terminate access where there is evidence of misuse, security risk, or breach of these Terms.
5. Data and Privacy
In the course of using the Service, personal data about you (including your name, email address, working schedule, and absence records) is processed. Your Company acts as the data controller; the Provider acts as a data processor on its behalf.
Processing is carried out in accordance with the Swiss Federal Act on Data Protection (nFADP / LPD) and, where applicable, the EU General Data Protection Regulation (GDPR). For full details, please read the Privacy Policy, which forms part of these Terms.
6. Intellectual Property
All software, design, content, and documentation forming part of the Service are the exclusive property of the Provider or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service solely for the purposes described herein. No other rights are granted.
7. Availability and Modifications
The Provider aims to maintain high availability of the Service but does not guarantee uninterrupted access. Planned maintenance windows will be communicated where reasonably practicable.
The Provider may update, modify, or discontinue features of the Service at any time. Material changes to these Terms will be notified to you in advance, and continued use after the effective date of the new version constitutes acceptance.
8. Limitation of Liability
To the maximum extent permitted by Swiss law, the Provider shall not be liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service. The Provider's total liability shall not exceed the amounts paid by your Company for the Service in the three months preceding the event giving rise to the claim.
9. Governing Law and Jurisdiction
These Terms are governed by Swiss law. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Switzerland.
